Process for the preparation of the supreme decree establishing collection and recovery targets for textiles is initiated

On March 10, 2026, Exempt Resolution No. 1,064/2026 of the Ministry of the Environment (the “Resolution“) was published in the Official Gazette, initiating the procedure for the preparation of the Supreme Decree that will establish collection and recovery targets and other associated obligations for textiles, within the framework of extended producer responsibility regulated by Law No. 20,920 (REP Law).

Among the most relevant aspects of the Resolution, the following stand out:

  • Initiation of the procedure and preliminary scope. The Resolution formally initiates the regulatory procedure and establishes, on a preliminary basis, that “textiles” shall be understood as those products composed mainly of textile fibers, regardless of their state of manufacture and the mixing or assembly process used. The priority product preliminarily comprises: (i) clothing; (ii) household textiles; (iii) footwear composed mainly of textile materials; and (iv) accessories and other textiles. These categories shall apply regardless of the product’s use and whether it is new or second-hand, provided it corresponds to its first introduction into the national market.
  • Submission of background information. A period of 45 business days from the publication of the Resolution is established for the submission of technical, economic, and social background information on the matter to be regulated. The background information must be substantiated and submitted in writing to the Office of Records of the Ministry of the Environment or sent by email to reptextiles@mma.gob.cl.
  • Expanded Operational Committee. The Resolution provides for the establishment of an Expanded Operational Committee, composed of public agencies and representatives of municipalities, textile producers, marketers and distributors, waste managers, consumers, grassroots recyclers, academic institutions, and non-governmental environmental organizations.
  • Preparation of the preliminary draft. The Ministry of the Environment shall have a period of six months from the publication of the Resolution to prepare and issue the preliminary draft of the supreme decree. Within this procedure, the available background information, the studies identified in the Resolution itself, and the observations or contributions gathered through consultation with the Expanded Operational Committee must be considered.

The Resolution constitutes the first formal stage of the process aimed at determining the targets and obligations that will apply to the new priority product “textiles.” The final content of such targets, the regulated categories, and the other associated obligations will be defined in the supreme decree issued at the conclusion of the procedure.
