According to Law 20,920, the implementation of the EPR Law requires the issuance of different related regulations, including:
- Regulation that establishes the Procedure for the Preparation of Supreme Decrees: It is in force. It was approved and published in the Official Gazette on November 30, 2017.
Regulation DS 8/2017 - Regulation for the Recycling Fund: It is in force. Article 31 of Law 20,920 establishes a fund, in charge of the Ministry of the Environment, to finance projects, programs and actions to prevent the generation of waste and promote its reuse, recycling and other kinds of recovery, which will be executed by municipalities or related associations. It was approved and published in the Official Gazette on October 17, 2017.
Regulation DS 7/2017 - Supreme Decree that sets forth the collection and recovery goals for containers and packaging: In force. It was approved by the Ministry of the Environmental by means of Supreme Decree No. 8, dated June 8 2020, which was published in the Official Gazzette on March 16, 2021
Supreme Decree - Supreme Decree that sets forth the collection and valorization goals for tires: In force. It was approved by the Ministry of the Environment by means of Supreme Decree No. 8, dated May 28, 2019, which was published in the Official Gazette on January 20, 2021.
Supreme Decret 08/2019 - Regulation for the Cross-Border Waste Movement: It was issued by the Ministry of the Environment by means of Supreme Decree No. 9 and entered into the CGR for its legal review process, which is currently pending.
CMS Agreement - Regulation for the modification of Supreme Decree No. 1/2013 that approves the Registry of Emissions and Transference of Pollutants Regulation: Supreme Decree No. 31 was published in the Official Gazette on December 11, 2018, including the modifications required by the EPR Law.
Modifications to RETC – DS 31/2018 - Regulation for the modification of the General Construction and Urbanism Ordinance to introduce a simplified procedure to obtain construction permits for reception and storage facilities for priority waste subject to Law 20,920: The draft was developed by the Ministry of the Environment and the Ministry of Housing and Urbanism, and already entered into the CGR for its legal review process. Its issuance is currently pending.
- Supreme Decree that establishes a simplified procedure for sanitary authorizations of waste reception and storage facilities: The Ministry of the Environment and the Ministry of Health are in the process of preparing it.
- Supreme Decree that establishes collection and valuation goals and related obligations regarding lubricating oils: It is not yet in force. By means of Exempt Resolution No. 264, dated March 29, 2019, the Ministry of the Environment initiated the process of elaboration of the Supreme Decree. By means of Exempt Resolution No. 1.269, published in the Official Gazette on December 3, 2020, the preliminary draft was submitted to public consultation.
Exempt Resolution 801/2019 - Supreme Decree that establishes collection and recovery goals for small batteries and electrical and electronic devices: It is not yet in force. By means of Exempt Resolution No. 310, dated April 16, 2021, the Ministry of the Environment initiated the process of elaboration of the Supreme Decree.
