On May 2, 2023, by means of Resolution 410 (“Res. 410/2023”) the Ministry of the Environment (“MMA”) issued a request for information to the producers of priority products, within the framework of Law No. 20,920 (“EPR Law”).
The information requested by Res. Ex. 410/2023 applies to producers of the following priority products: (i) lubricating oils; (ii) electrical and electronic equipment; (iii) batteries and small batteries; (iv) containers and packages (including those producers that introduce in the market less than 300 kg of containers, reusable containers and containers belonging to the subcategory “others”); (v) bicycle and wheelchair tires, and solid tires; and (vi) newspapers and magazines.
Producers must report the amount (units, cubic meters and/or tons) of priority products brought into the national market during the year 2022. Additionally, in the case of reusable containers, they must report (i) the tons of new reusable containers they have acquired; (ii) the tons of new reusable containers that have become waste in possession of the producer and; (iii) the tons of reusable containers that have been used to commercialize packaged goods, distinguishing how many corresponded to new containers and how many corresponded to containers recovered after at least one use.

Compliance with this information request is subject to the supervision of the Superintendence of the Environment, which is also entitled to sanction non-compliances with it.
