Goals and Obligations for Lubricating Oils
On November 11, 2024, Supreme Decree No. 47/2023 of the Ministry of the Environment was published in the Official Gazette, establishing collection and recovery goals and other obligations associated with lubricating oils, in the the context of Law 20.920 on Extended Producer Responsibility.
Regulated Object
The decree applies to all lubricating oils introduced into the national market, understood as “mineral or synthetic oils that fulfill a lubrication function, whether they are combustion engine oils, gearbox oils, turbine oils, hydraulic oils, or others, which, fulfilling different functions, have a chemical composition similar to these,” regardless of whether the lubricating oil is an integral part of a vehicle or machinery of any kind, or if they have been introduced into the national market separately.
Collection and Recovery Goals
Producers of recoverable lubricating oils, excluding those who introduce an amount equal to or less than 66 liters per year into the national market, must meet the following collection and recovery goals through a management system, which may be individual or collective:

Obligations of Producers
Additionally, producers subject to extended producer responsibility must comply with the following obligations:
- Register with the RETC and provide the requested information.
- Organize and finance the collection of used lubricating oils throughout the national territory.
- Comply with the associated obligations established in Title IV of the Decree.
- Ensure that the management of used lubricating oils is carried out by authorized and registered managers.
- Ensure that sensitive commercial information shared in compliance with the Law cannot be known by other producers.
Entry into force
The collection and recovery goals for lubricating oils, and the obligations associated with them, will enter into force on January 1, 2027.
